Today, the Oregon Senate approved a bill that will grant 50 percent of any unclaimed funds in state class actions to the Oregon State Bar to support legal aid. This is a great victory for cy pres proponents as Oregon was the only state that previously required that any unclaimed funds revert to the defendant. On February 26, 2015, APBCo issued a letter of support for the bill as part of its continued efforts to advocate for cy pres in class action in litigation, and more importantly, for cy pres awards to be granted to legal aid organizations.
